<br />MR. KROEGER: <br /> <br />MR. CORNELIUS: <br /> <br />MR. KROEGER: <br /> <br />BOARD MEMBER: <br /> <br />are three principal things that the United <br />States desires in the contract. One is that the <br />channel below the proposed Bear Creek dam will <br />be kept free of obstruction. This poses no real <br />problem since the Corps has prepared a revised I <br />flood hazard area along Bear Creek which is quite <br />small. This was prepared on the basis that the <br />dam would be in operation. We expect no dif- <br />ficulty in getting that area zoned through the <br />cities and the county concerned. which is <br />Jefferson County. <br /> <br />The second area is that the state will hold <br />the United States harmless in matters involving <br />water rights. Actually. water administration is <br />under the jurisdiction of the State of Colorado, <br />and more specifically under the State Engineer's <br />office. So that is normal routine for us and <br />the state is not incurring any liability there. <br /> <br />The third one is that the state will comply <br />with the Relocation Act. That is a fairly recent <br />act of Congress which states that in the event <br />that people have to be moved, that assistance <br />must be provided to them in finding new homes <br />and moving expenses, et cetra, have to be paid. <br />In this case, there are no homes involved as far <br />as the channel is concerned, and the state is <br />not acquiring any land in connection with the <br />Bear Creek project. There is nothing for us to <br />do in connection with relocation in the channel. <br />There is some relocation which will occur in the <br />reservoir area, but that is a federal respon- <br />sibility and this contract pertains to the <br />channel below the reservoir." <br /> <br />"Are there any questions, board?
