<br />) <br /> <br />) <br /> <br />Consent Agenda Item 4-1.f <br />Case No. 5-99CW240; Horseback, Inc./Roaring River Ranch, LLC <br /> <br />Application Summary <br /> <br />This is an application for a plan for augmentation, change of water rights, exchange and surface and <br />storage water rights on the Roaring Fork River in Pitkin County near the town of Aspen (see <br />attached map). The Applicant is proposing to augment depletions associated with the evaporation <br />of the Kinder Ponds Nos. 1, 2, and 3 and the inigation of 0.5 acres with releases from Ruedi <br />Reservoir. The Ponds have an appropriation date of June 15, 1996 for aesthetic, piscatorial and fIre <br />protection uses and will be filled using the Kinder Pump and Pipeline (0.27 cfs). In addition, the <br />Applicant is requesting that the Kinder Pump and pipeline be an alternate point of diversion for 0.27 <br />cfs associated with the Pine Grove Pipeline. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow right on the Roaring Fork River for 55 cfs during the summer <br />(April I to September 30) and 30 cfs during the winter (October 1 to March 31) with an <br />appropriation date of November 8, 1985, which could be injured by this application. <br /> <br />Potential for Iniury <br /> <br />) <br /> <br />The Applicants' proposed plan for augmentation may not replace depletions to the Board's instream <br />flow water rights on the Roaring Fork River in the same time, amount and location as they have <br />historically occurred.
