I thought we had made remarkable progress toward settlement when we met <br />in April. <br /> <br />We think the CWCB's ultimate objectives should be to obtain a consent decree in the base <br />flow case, and to dismiss the recovery flow case, However, it probably is premature to finalize <br />either action until further discussion has taken place within the Recovery Program, as suggested by <br />Tom Pitts in his letter of June 11, 1998. From the CWCB's agenda. it appears that final action is <br />not planned until a later meeting; that may allow time for the necessary dialogue. In such <br />discussion, the CWCB should seek to assure that Slate law will continue to provide the basis for any <br />protection of flows under the recovery program. <br /> <br />In negotiating any decree for the base flow case, protection for existing projects will need <br />to be at least as strong as that provided in the 581 C.F.S. decree (Case No. 92CW286). <br /> <br />.,.......
