Wendy Weiss
May 7,1998
Page 2

clients remain willing to discuss a proposed recovery agreement and proposed biological opinion
which mliY provide the water users with more certainty in their water supply use and planning.

We also wanted to express our view that the withdrawal of the Service's support and the
dismissal of the 1995 flow filings altogether may pose an opportunity for the CWCB to develop
a new application for a more appropriate flow right under state law. The right could potentially
be used to protect the fish releases from the upstream storage sites under the check settlement,
Programmatic Biological Opinion and existing Service contracts. Perhaps the CWCB should
begin initiating a dialogue with the water users about this possibiliry.

Please share this correspondence with the Board at the meeting next week.

Thank you.

Very truly yours,

/
/
I ,.
C9MB, P.C.

By

LS/mmg

xc: Eric Kuhn
Maureen Toomey
Dan Kerst, Esq.
Harry Mosgrove
Elizabeth Black
Jack BestaIl
Frederick G.
