In addition, <br />we join in Mr. Glenn Porzak's letter dated May 27,1998 and the points made therein. <br /> <br />Both cases should be dismissed. The issue of how, under State law, to secure flows for the <br />fish should be carefully considered in conjunction with the soon to be filed cases claiming flows <br />from Rifle to the State line. The base flow cliams only could be refiled then as part of the overall <br />solution, if indeed all of these claims do represent part of a solution at all. <br /> <br />The strength of the Board's history with respect to instream flow filings has always rested <br />on the sound biological basis that could be demonstrated therefor. One of the serious political <br />problems they have encountered with these filings (Division 5 Case Nos. 95CW296 and 95CW297) <br />
