GENERAL COUNSEL ])( tf- <br />CWCB ENDANGERED FISH INSTREAM FLOW CLAIMS <br /> <br />SUBJECT: <br /> <br />. <br /> <br />Dear Directors: <br /> <br />You are aware that in the negotiations for a "programmatic" biological opinion <br />regarding existing and future water project depletions above the IS-Mile Reach the Fish & Wildlife <br />Service recently made an important announcement. At a May 4'" meeting of the workgroup which <br />has been meeting about that biological opinion, the Service announced that it is withdrawing its)~ <br />support for the CWCB's pending instream flow claims for the IS-Mile Reach because it has <br />concluded that the claims would not provide any significant benefits for the endangered fish. <br /> <br />The Service indicated that its analysis and conclusion about the I S-Mile Reach claims also <br />should apply to the Yampa River claims. There is no ongoing process in the Yampa River basin <br />which requires the Service to decide now whether Yampa River flow claims are meaningful (i.e., <br />whethe: the Service' also will "withdraw support" for those claims). <br /> <br />The CWCB has requested input from interested parties regarding the Service's withdrawal <br />of support for the IS-Mile Reach instream flow claims. Because the CWCB will receive such <br />co=ents and consider them before your regular meeting in July, River District staffneed your <br />direction at your June meeting about any input to provide to the CWCB on this matter. <br /> <br />.~, <br /> <br />The issue for consideration ill what should be the River Dilltrict's position on and <br />comment to CWCB about the dispositiou of the IS-Mile Reach flow claims. Should those claims <br />be withdrawn or maintained in a "filed" status pending some future decision? Should any <br />withdrawal decision apply both to the "base flow" and the "recovery flow" claims?
