Dear Peter and Wendy:

Both of you have advised that the Cwc13is soliciting input about the potential disposition
of its pending instream flow claims for the Colorado River mainstcm (IS-Mile Reach) and the
Yampa River. The Colorado River District hIlS been an active party in those cases llnd in the
Recovery Progr8Jl1. Our Board supported the filing of those claims (Cases No. 5-95CW296 & 297
and 6.95CW1SS & 156) by motion adopted October 16,1995 as follows:

(T]he Colorado River Water Conservation District supports the efforts of the
Colorado Water Conservation Board in maintaining sufficient progress under the
Recovery Program for Endangered Colorado River Fishes by appropriating instrcam
flows under state law prior to December 31,1995, provided that the water rights to
be obtained by such appropriations do not serve to deny Colorado water users the tul1
development of Colorado's Compact entitlement to beneficial consumplive use of
water of the Colorado River and also provided that such rights are subjecl to terms
and conditions consistent with pertinent District policies.
