This matter involves the application brought by Upper Gunnison for a <br /> <br />recreational in-channel diversion ("RICD"), the first case to be tried under Senate Bill 216, <br /> <br />C.R.S. 99 37-92-101 et seq. As provided in C.R.S. 9 37-92-102(6), a hearing was held before the <br /> <br />Colorado Water Conservation Board ("CWCB") on September 1 0, 2002. The Board of Directors <br /> <br />deliberated both at that hearing and by telephone conference on October 1, 2002. CWCB issued <br /> <br />its written Findings and Recommendations on October 11, 2002. <br />
