Seppi and <br />S&Z Ltd., Eagle Park Reservoir Company, City of Florence, Public Service Company of Colorado, Lake <br />County Board of Commissioners, US Bureau of Land Management, US Forest Service, Colorado <br />Division of Wildlife and Mount Massive Lakes, Inc. <br /> <br />Our staff will review Pueblo's request and the East Tennessee Creek Aquatic Mitigation Plan <br />Report to determine if there is an interference with the East Tennessee Creek instream flow right (Case <br />No. 77W4650). They plan to report the results of this investigation to us in November. <br /> <br />Trinidad Project Operating Principles: Proposed amendments to the Trinidad Project <br />Operating Principles will again be considered at a meeting scheduled for October 19,1999, in Denver. <br />USBR, PRWCD, Colorado, and Kansas will try to narrow outstanding issues and reach agreement on <br />provisions that can be modified at this time. Kansas recently furnished proposals that address stockwater <br />release issues (allows a 1200 AF/year reservoir bypass for winter stockwatering) and temporary detention <br />and subsequent release of flood flows at Trinidad Reservoir. Both appear to be reasonable attempts to <br />meet the District's needs while protecting downstream water users. The PRWCD has not yet indicated if <br />these proposals are acceptable to them. I plan to respond to Kansas' two proposals after consulting with <br />water users in District 67 and the PRWCD before the October meeting. <br /> <br />The remaining issues are more difficult. We are waiting for additional mapping of irrigated <br />. acreage from USBR to be able to assess and assist in developing an irrigated acreage tracking and <br />verification system that assures all parties that project water use is consistent with original modeling <br />assumptions. We are also looking to Colorado water users below John Martin Reservoir for engineering <br />assistance in developing a reasonable and feasible technical work plan for evaluating the most <br />controversial proposal, winter storage at Trinidad Reservoir under direct flow priorities outside the 20,000 <br />AF transferred model storage right limitation. <br /> <br />Cabeza de Vaca v. Babbitt, et al: On August 6, the federal District Court dismissed this suit on <br />the grounds that the United States had not waved its sovereign immunity. However, the Court indicated a <br />remedy might be available under Administrative Procedures Act. <br /> <br />Arkansas Headwaters Recreation Area Citizens Task Force: The Citizens Task Force for the <br />Arkansas Headwaters Recreation Area will hold its regular meeting from 9:30 am until 3 :30 pm on <br />Wednesday, September 29th, 1999 at the AHRA office in Salida. The agenda will focus on the <br />Management Plan revisions. For more information contact the AHRA office at 719-539-7289 or CTF <br />Chairperson, Rod Kuharich, at 719-448-8005. <br /> <br />. <br /> <br />Colorado River Basin Issues <br /> <br />Miners Creek ISF Modification Investigation: Staffs from the Colorado Division of Wildlife <br />(DOW), the Attorney Generals Office, and the CWCB visited Miners Creek in late August and early . <br />September to collect additional data. CWCB staff has also utilized the Colorado River Decision Support <br />System and gage records from nearby streams to develop additional hydrologic models to estimate the <br />stream flow in Miners Creek. The staffs are reviewing reports and information that has been provided to <br /> <br />. <br /> <br />8 <br />
