In all, $4.3 billion in federal <br />money would be contributed toward to total project costs of $6.3 billion. <br /> <br />Title II of the bill includes authority for the Corps to undertake a "Challenge 2 I" program for flood <br />mitigation and river restoration, using non-structural measures to restore the natural functions and values <br />of rivers throughout the U.S. in consultation with state and local agencies and tribes. The total federal <br />cost of a project under this program is limited to $15 million and no more than $30 million may be spent <br />on any single project. The bill authorizes $200 million for the program over five years, including $20 <br />million in FY 2001. <br /> <br />. <br /> <br />Indian Water Rights Report: A working group of officials within the Interior and Commerce <br />Departments have prepared a draft "Report on the Endangered Species Act and Indian Water Rights" <br />dated August II, 1999. They have circulated this draft through the Western States Water Council, the <br />Western Association of Attorneys General and other organizations with a request for comments by <br />October 15. The draft report reflects an overall concern for the protection (and development) of tribal <br />water rights within rivers that are near full development and may already be limited by the requirements <br />of the ESA. The report reflects the federal agencies' perception that water resource for Native American <br />communities has historically received low priority and tribal frustrations that federally financed water <br />projects for non-tribal development are now considered part of the environmental baseline as the tribal <br />projects confront ESA regulatory review. <br /> <br />We were unable to complete our review of this report in time for this meeting and will continue <br />working with the Attorney General's staff to give you an assessment of its potential implications.
