<br />~. <br /> <br />, <br /> <br />Harris Water Engineering of Durango is the consultant for the feasibility study. To date, staff <br />has approved $12,636.20 in invoices under the contract. <br /> <br />- <br /> <br />In November of 1994, the Board approved a Construction Fund loan of $2,250,000 to the <br />Company for the rehabilitation and enlargement of the reservoir upon the condition of submittal <br />of a completed feasibility study. The loan was subsequently authorized by the General <br />Assembly in HB 95-1155. <br /> <br />Discussion <br /> <br />Harris Water Engineering submitted a draft feasibility report in January 1995 and CWCB staff <br />responded with a number of comments and suggestions. A final report with an opinion of <br />feasibility has not yet been submitted and the Company does not feel that it is ready to make <br />such a determination at this time. Please see the attached letter from Trent Taylor, Vice President <br />ofthe Company citing the reasons why the Company would like to defer the question of <br />feasibility. <br /> <br />As a way of bringing closure to the contract situation, staff would like to request that the Board <br />consider forgiving the feasibility study loan. All of the work to date would be compiled in a <br />project status report by the consultant (without a conclusion regarding feasibility). The Company <br />would be willing to pay any costs associated with the completion of the status report. The <br />question of feasibility could then be addressed at a later time when outstanding issues appear to <br />be closer to resolution. <br /> <br />Recommendation <br /> <br />. <br /> <br />Staffrecommends that the Board forgive the feasibility study loan to the Red Mesa Ward <br />Reservoir and Ditch Company under Contract No. C153686 in the amount of$12,636.20. As a <br />condition of forgiveness, the Company will submit a project status report on the Red Mesa <br />Reservoir rehabilitation and enlargement project to the CWCB staff.
