Upon subdivision of the property described in Paragraph <br />No.5, suora, Randolph Capital shall create a property owners <br />association, which all purchasers of residential lots shall be <br />required to join. The property owners association shall complete <br />an annual inventory of the number of homes constructed within the <br />subdivision and the total area of turf grass and gardens being <br />irrigated. The property owners association shall submit such <br />information to MMRC on or before November 1 of each year. <br />Depletions from the structures described herein shall be calculated <br />by adding the sum of the following components: (1) the number of <br />single family homes built and occupied, multiplied by 0.0157 of an <br />acre foot, and assuming an equal monthly distribution of water use <br />throughout the year; (2) the number of acres of irrigated turf <br />grass, mUltiplied by 1.0 acre foot per acre; and (3) the number of <br />acres of irrigated gardens" multiplied by 0.4 of an acre foot per <br />acre, MMRC shall include depletions from the SUbject wells which <br />are out-of-priority, in the reports made to the State water <br />officials for other plans for augmentation which utilize MMRC <br />augmentation water supplies. On the basis of the submitted <br />reports, and in accordance with the directives of the Division <br />Engineer, MMRC shall make the required release of augmentation <br />water by properly documenting the instream delivery of replacement <br />water from the Warrior Ditch and the Harriman Ditch, or the release <br />of storage water from the Soda Lakes Reservoirs. It shall be the <br />responsibility of Randolph Capital, or its assigns, to release <br />water from any on site storage container. The release of storage <br />water shall be subject to the conditions stated in paragraph No. <br />16, SUDra. An example of the type of information to be included <br />in the water accounting to be maintained by the Applicants is <br />attached as Exhibits 'E" and "F." It is not the Court's intention <br />to mandate the use of the Exhibits "E" and "F" in their existing <br />format. The Exhibits have been included simply to provide an <br />illustration of the information that must be gathered and recorded. <br />The Applicants, in coordination with the Division Engineer, can <br />modify the forms in the future as changes may become necessary for <br />proper administration. <br /> <br />29. As a result of t~e approval of this Plan for <br />Augmentation, the vested rights of others will not be materially <br />injured by diversions from the wells described in Paragraph No.6, <br />SUDra. Accordingly, the State Engineer shall issue permits for the <br />wells upon the submittal of applications by Randolph Capital or its <br />assigns. <br /> <br />30. Pursuant to the provisions contained in 937-92-304(6), <br />10 C.R.S., (2000), the plan for augmentation decreed herein shall <br />be subject to the reconsideration of this Court, for the purpose <br />
