<br />Agenda Item 6x <br />Case No. 5-98CW312; Los Amigos Ranch Partnership <br /> <br />Application Summary <br /> <br />This is an application for groundwater rights, change of water rights and a plan for augmentation <br />on the Crystal River near the Town of Carbondale in Garfield County (see attached map). <br />Applicant seeks to change the point of diversion for 0.67 cfs associated with the Landis Canal <br />from its decreed point of diversion on the Fryingpan River to a wellfield tributary to Edgerton .. <br />Creek that is tributary to the Crystal River. The wellfield will serve as the water supply for a <br />140-single family residential development located on 670 acres. Applicant proposes to augment . <br />out-of-priority depletions associated with this development with releases from Ruedi Reservoir <br />and/or Green Mountain Reservoir. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instrearn flow water right in case no. 5-75W2720 for the Crystal River in the <br />amount of 100 cfs in the summer months and 60 cfs in the winter months with an appropriation <br />date of May I, 1975 which could be injured by this application. <br /> <br />Potential for Iniurv <br /> <br />The Applicant's proposed change in point of diversion may deplete the Board's instream flow water <br />rights on the Crystal River. In addition, the proposed plan for augmentation may not be sufficient to <br />replace the depletions to the Crystal River in the same time, amount or location at which they occur. <br /> <br />Other Objectors <br /> <br />Other objectors include the Colorado Mountain College District and Aspen Springs Ranch, Inc. <br /> <br />L:\BOARDMEM\Man:h 99\agcnda i_ 6x.doc <br /> <br />.-;;;, <br />
