I provide you with the following comments upon <br />that proposal. In general, the suggested modifications are self- <br />explanatory except as otherwise noted. <br /> <br />1. Rule 10.23 Recovery Implementation or Other <br />Intergovernmental Agreement. An ISF right may be modified if <br />such modification was agreed upon by the Board as part of the <br />Recovery Implementation Plan for the Endangered Fishes of the <br />Colorado River Basin or any other agreement between the Board and <br />another governmental entity, Modifications made as a part of the <br />Recovery Implementation Plan for the Endangered Fishes of the <br />Colorado River Basin need not be subject to the public review <br />process in Sections 10.50-10.54. Criteria for modifications made <br />IN THE INSTREAM FLOW RIGHTS DECREED as part of the Recovery <br />Implementation Plan for Endangered Fishes of the Colorado River <br />Basin will be determined ESTABLISHED in the decrees af the <br />appropri~to ~Iater caurt GOVERNING SUCH APPROPRIATIONS. <br /> <br />e.' <br /> <br />2. Rule 10.40 Review of Request for Modification. If in <br />the discretion of the Board a request for modification of an <br />existing ISF right is consistent with the goals of the ISF <br />Program, the Board shall issue a final written determination <br />regarding the decrease that shall state its effective date, AND <br />THE FACTUAL BASIS THEREFORE. IT SHALL be mailed promptly to the <br />persons who appeared by written or oral comment at the Board's <br />proceeding, and be filed promptly with the water court. <br /> <br />s:\legal\mtp\1:r\rnerriman.127 <br />
