<br />-46 <br /> <br />The Director. stated that he had attempted to get in touoh with <br />Mr. Warren to advise that he appear at.this meeting regarding this .matter but <br />found that Mr. Warren is now in C&liforni~ and would not return for SOme <br />weeks. <br /> <br />It was moved by Judge O'Rourke and seconded by Judge <br />McHendrie, that the matter be deferred until such time as the <br />Boardi would have the opportunity of Mr. Wsrren appear=ing before the <br />Board and th~t the Colorado interests interested in the matter be <br />given an opportunity to appear. . <br /> <br />Upon vote being taken a moticn ,.as carried and declared <br />adoE1;ed, . <br /> <br />I <br /> <br />~ean S. Breitenstein then made a report on the undergroUnd water <br />adjudications before the Court in the Seventh Judicial Distri~t of the <br />State. He stated that he had gone to Grand Junction at the time of the <br />hearing on the motion as to whether the Court would entertain an adjudication <br />of the rights to underground water supplies and made a statement ~o the <br />Court as authorized at the last Board meeting. No decision On the motion <br />had as yet been made. by the Court. <br /> <br />Thereupon a discussion ensued with respect to the desirability of <br />drafting proposed legislation for an underground water code for the State vi' <br />Colorado. ;t was pointed out that a committee had been appointed by the <br />Water Section of the Colorado Bar Association in an attempt to formulate <br />principles for an underground water ~ode. It was suggested by Mr. Saunders <br />and Mr. Breitenstein that the Board Should indicate whether it approves the <br />action of the Water Seotion of the Colorado Bar Association in advocating <br />the fvrmu.':'9:ti:.:n of' an u..lldt:rgrourid wa1:er oode. <br /> <br />After further discussion, it was moved by Mr. Smith and seconded <br />~y Mr. Saund~rs, tlmt Lhe Water Se~tion of the Colorado Bar <br />Association should proceed in an attempt to formulate the <br />pr lilciplea; of an underground ",ater code. <br /> <br />Upon vote. being taken the motion was unanimously carried <br />and declare~ adopted. <br /> <br />Mr. Breitenstein inquired whether the Board'deslred him to follow' <br />up with the underground water adjudioations. at 'Grand Junction, Colorado. The <br />Board indioated that it so desired. <br /> <br />Director Stone, Commissioner for Colorado on the Upper Colorado <br />River Basin Compaot Commission, made a report of the status of the Upper <br />Colorado river compact negotiations, He stated that since the last meeting <br />of the Board the Commissi.on had held a series; of meetings whioh together I <br />constituted the third session of the Commission. These meetings were held <br />at Rqok Springs, w~oming, Grand Junction. Colorado, Price, Utah and <br />Fa~ington, New Mexico. It required a week to hold these meeting~. The <br />purpose of the meetings was to explain to the interested oitizens; of the four <br />States the reasons for negotiating a compaot at this time and to obtain <br />from th~m e.l1y ouggestions or cvlllr.lents. for the benefit of the Cam!nission in <br />negotiating a compact. <br />
