This is an application for surface water rights, storage water rights, and approval of a plan for
augmentation near Crested Butte. Applicant seeks to continue using Lacy Spring Nos. 1 through 4
and the Verzuh-Young-Bifano Ditch for existing and new uses that include domestic, stock
watering and recreational uses within a 200-acre property. The property will include a new main
residence, an apartment, an office, an old cabin, six RV hookups, an indoor riding arena, 25 horses,
and 300 head of cattle. In addition to the four springs, Applicant plans to operate four ponds plus a
previously decreed pond (Trey's Pond in Case 4-96CW298) for the operation of this venture in
conjunction with the plan for augmentation. Applicant estimates the augmentation requirements to
be 4.04 af7yr and proposes to release water stored in priority from the ponds at the discretion of the
Division Engineer.

Potential for Iniury

The Applicant's proposed plan for augmentation may injure the Board's instream flow water right
on the Slate River and the East River by not replacing depletions in time, place and amount.

Other Objectors

Whetstone Vista Association, Inc. and Brush Creek Estates Association also filed statements of
opposition to this application.
