<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 12a( 4) . <br />Case No. 5-94CW022; UERW A and Avon Metro . <br /> <br />Case Summary <br /> <br />The Board ratified the Statement of Opposition filed in this case at its May 25, 1994, meeting. <br />This is an application for change of water rights on the Eagle River and Gore Creek near Vail in <br />Eagle County (see attached map). Applicants propose upstream alternate points of diversion at <br />the Vail Valley Consolidated Wel1s for the 10 cfs municipal water right decreed to the Avon <br />Metropolitan District Municipal Water System (AMMWS). <br /> <br />The Board holds the fol1owing instream flow decrees on the Eagle River and Gore Creek: <br /> <br />Case No. Stream Amount ( cfs) Approp. Date <br />80CW134 Eagle River 85/35 3/17/80 <br />77W3636 Gore Creek 22/8 7/27/77 <br />77W3637 Gore Creek 16/6 7/27/77 <br />Stipulation <br /> <br />Applicants have agreed to the following terms and conditions which wil1 provide full protection <br />for the Board's instream flow water rights on the Eagle River and Gore Creek. <br /> <br />. During May through October, diversions under the Changed Water Rights at the <br />additional alternate points of diversion wil1 be limited to periods when the stream <br />flow in Gore Creek is equal to or exceeds 16 cfs immediately below said alternate <br />points of diversion. If said diversions are made during other times of the year, such <br />diversions will be made only when the flow in Gore Creek is equal to or exceeds 6 cfs . <br />immediately below said alternate points of diversion. <br /> <br />· At the discretion of the Division Engineer, the stream flow in Gore Creek <br />immediately below said alternate points of diversion may either be measured directly <br />or calculated based upon flow readings at the Gore Creek gage (09066310), located <br />on Gore Creek approximately 0.1 mile upstream from Red Sandstone Creek. <br /> <br />· Applicants shall, at their own expense, install, maintain, and monitor at locations <br />determined by the Division Engineer, such measuring devices deemed necessary <br />pursuant to 937-92-502(5) C.R.S., or provide such calculations as required by the <br />Division Engineer to administer the terms of this decree. <br /> <br />A:\594CW022.STP <br /> <br />iib'. <br />
