This is a second amended application for approval of plan for augmentation and <br />appropriative right of exchange on Capitol Creek, Snowmass Creek, and the Roaring Fork River <br />near Snowmass in Pitkin County (see attached map). Applicant proposes to augment its out-of- <br />priority depletions with releases of water from either Ruedi Reservoir or several on-site ponds. <br /> <br />The Board holds the following instream flow decrees on Capitol Creek, Snowmass Creek, and <br />the Roaring Fork River. <br /> <br />Case No. <br /> <br />Stream <br /> <br />Amount (cfs) <br /> <br />Aooroo. Applicant agrees to either: <br />1) curtail its out-of-priority depletions under this plan for augmentation, or <br />2) replace said out-of-priority depletions at or upstream of its diversion structure at <br />anytime the streamflow Snowmass Creek immediately below applicant's <br />diversion structure is less than 12 cfs, the amount of the Board's instream flow <br />water right. <br /> <br />. Applicant agrees to curtail its April 10, 1992, upstream exchange from storage in Ruedi <br />Reservoir to storage in its augmentation ponds located on Capitol Creek or Snowmass <br />Creek at times when the streamflow in Capitol Creek is less than 10 cfs or the streamflow <br />in Snowmass Creek is less than 12 cfs immediately below the points of diversion into <br />said ponds. <br /> <br />. Pursuant to C.R.S. g37-92-502(5), Applicant shall instaII, maintain and monitor at <br />locations determined by the Division Engineer, and at Applicant's expense, such <br />measuring devices deemed necessary by the Division Engineer to administer the terms of <br />this decree. <br /> <br />A:\591CW263.STP <br />
