<br />. <br /> <br />e <br /> <br />Agenda Item 12a(1) <br />Case No. 2-97CWII 0; Steele . <br /> <br />',v--'- <br /> <br />Case Summary <br /> <br />The Board ratified the Statement of Opposition filed in this case at its January 28, 1998, meeting. <br />This is an application for surface water rights on Cottonwood Creek in Chaffee County (see <br />attached map). Applicant seeks to appropriate 3.266 gallons per minute of water from Antelope <br />Spring, without diversion, to maintain and preserve wildlife habitat and the existing natural <br />ecosystem. The date of appropriation is January 10, 1997. The application states "We are not <br />diverting the water. We are making this application in order to ensure that the spring is not <br />diverted from its current course." The spring starts in section 18 and flows through section 20 <br />which is where the Applicant's property lies. <br /> <br />The Board holds no instream flow water right on this creek. <br /> <br />Withdrawal of Statement of Opoosition <br /> <br />The Applicant has amended the application to make an appropriation for piscatorial purposes in a <br />fish pond to be constructed off-channel of the stream. Since there is no affected instream flow <br />water right, and the applicant is no longer seeking an instream flow water right, the Staff has <br />requested the Attomey General's office to withdraw the Statement of Opposition in this case. <br /> <br />e <br /> <br />e L:\BOARDMEM\may98\l2a(I).doc <br />
