<br />. <br /> <br />~ <br /> <br />e <br /> <br />Agenda Item 12a(7) <br />Case No. 7-96CW093; Cecil and Debra Baldwin <br /> <br />Case Summarv <br /> <br />The Board ratified the Statement of Opposition filed in this case at its March 1997, meeting. <br />This is an application for a change of water rights on the East Mancos River near the Town of <br />Mancos in Montezuma County (see attached map). Applicants are requesting to move the <br />existing point of diversion of the Samson Ditch upstream approximately 2 miles to an alternate <br />point of diversion located at the Williams Ditch. Applicants are proposing to build some small <br />storage reservoirs and divert water from the Williams Ditch into storage. The water from the <br />reservoirs will be distributed through gravity pressure lines to sprinklers for irrigation purposes <br />on the same lands that have been historically irrigated. <br /> <br />The Board holds an instream flow decree on the East Mancos River for 2 cfs year-round which <br />may be injured by this application. <br /> <br />Stioulation <br /> <br />Applicants have agreed to the following terms and conditions which will provide full protection <br />for the Board's instream flow water right on the East Mancos River: <br /> <br />e <br /> <br />· Diversion at the Williams Ditch shall be limited to a maximum of 2 c.f.s. At no time. <br />can the combined amount diverted at the alternate point of diversion (Williams Ditch) <br />and at the original point of diversion (Samson Ditch) exceed the decreed water right of <br />2 c.f.s. <br /> <br />· Applicants shall curtail their diversions from the Williams Ditch at any time the <br />streamflow of the East Mancos River is less than 2 c.f.s., the amount of the Board's <br />instream flow water right decreed in Case No. 84CW268. <br /> <br />· Diversions at the requested alternate point of diversion (Williams Ditch) shall be <br />limited to the amount of water which is physically and legally available at the headgate <br />of the Samson Ditch during the annual historic irrigation season of April IS through <br />October IS. <br /> <br />· Pursuant to C.R.S. 9 37-92-502(5), the Applicants agree to install, maintain and <br />monitor such measuring devices deemed necessary by the Division Engineer to <br />administer the terms of this decree at those locations determined by the Division <br />Engineer.
