<br />-, <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Page 2 <br /> <br />The Applicants' original Application sought a decree for absolute water rights of 100 <br />c.f.s. for 10 boat chutes, eight boulder clusters, and four deflectors to control river flows. As the <br />proposed Stipulation shows, the Applicants omitted the boulder clusters and the rock deflectors <br />from the proposed Decree because the Fort Collins case involved only boat chutes. <br />Additionally, the Applicants narrowed the proposed request to boat chutes within four narrow <br />reaches, instead of a broad stretch of river, because the Fort Collins boat chute was confined to a <br />reach of 400 feet. <br /> <br />After several field trips with CWCB Staff to both the Fort Collins structure and the <br />Littleton structures, it appears that the Littleton boat chutes and fish ladders function <br />properly. Based upon the standards set forth in Fort Collins, the Littleton boat chutes and <br />fish ladders would qualify as control structures that put the water to beneficial use. Finally, <br />since Littleton has requested only \00 c.f.s. (as opposed to the Golden application for \000 <br />c.f.s. discussed in the prior memo), there should not be an issue of whether the amount of <br />water is "reasonable and appropriate under reasonably efficient practices to accomplish <br />without waste the purpose for which the appropriation is lawfully made." ~ 37-92-103(3)(a), <br />10 C.R.S. (1999); Santa Fe Trail Ranches Property Owners Ass'n v. Simpson, 990 P.2d 46 <br />(Colo. 1999). <br /> <br />We recommend that the Board authorize the Staff to enter into the proposed <br />Stipulation with Littleton. <br />
