<br />30 <br /> <br />Whereas, a project net existing at the t;Lme of the closing of the evidence in <br />the North Platte suit or recognized in the decree in that suit is now <br />authorized by the COngress and planned for construction by the Bureau of <br />Reclamation,such project being ]mown as the Glendo Project and being <br />located in Wyoming near the town of Glendo, and <br /> <br />Vfuereas, such proposed Gle~o Project. wi~l have a total storage capacity of <br />about 1,000,000 acre-feet, and <br /> <br />I' <br /> <br />Whereas, there is need for too irrigation of more ;Land in Jackson County, <br />Colorado, than is permitted by the 1945 decree; <br /> <br />Now Therefore, Be It Resolved by the Colorado Water Conservation Board that: <br /> <br />(2) <br /> <br />,(1) <br /> <br />The restrictions on use of North Platte River water in Jackson <br />CoUnty, Colorado, as imposed by the 1945 decree, are Unrair and <br />ineQ!Uitable to Colorado and should be remoyed. <br /> <br />Negotiations should be promptly undertaken with Wyoming, Nebraska, <br />and the United States to determine whether or not such restrictions <br />may be removed" or satisfactorily modified by mutual agreement. <br /> <br />(3) <br /> <br />, <br />In the event that by November 1, 1951, negotiations have failed to <br />produce a satisfactory agreement or to indicate the probability <br />that such an agreement may be promptly reached, the Board requests <br />that the Attorney Gener~l.of the State of Colorado promptly insti- <br />tute such proceedings as he deems proper to secure the removal of <br />the restrictions of the 1945 decree on the use of North Platte <br />River water in Jackson County, Coiorado. <br /> <br />Be it further resolved that the Diractor and the Attorney for the Board <br />are directed to proceed diligently to effectuate this Resolution and in so <br />do~g to cooperate fully with the Kttorney General of Colorado. <br /> <br />Be it further resolved that the Director of the Board is directed to <br />transmit copies of this resolution to the Governo~s and Attorneys General <br />of the States of Wyoming and Nebraska and to the Attorney General and Secre- <br />tary of the Interior of the United States. <br /> <br />The motion for adoption of the resolution was seconded by A. E. Headlee <br />and on vote being taken the ~otion unanimously carried and the resolution <br />was declared adopted. <br /> <br />The Director called attention to the fact that representatives of the Aspen <br />Water-:-Organization were present and wished to present their statements in opposition <br />to the proposed Fryingpan-Arkansas Project. <br /> <br />1 <br /> <br />The Vice Chairman thereupon called upon Mr. J. H. Smith, Jr. of Aspen,Colorado. <br />Mr. Smith introduced Leonard Woods of the Aspm Chamber of Commerce. Mr. Woods pre- <br />sented a prepared statement. After Mr.Woods' statement, Mr. Smith read a statement <br />by Orest Gerbaz of Aspen (Pitkin County Water Protection Associa tion). Upon the con- <br />clusion of the Gerbaz statement, Mr. Smith made his own statement, saying that most of <br />his statment was in the form of notes; and then Mr. Smith introduced Mr. L. J. Usel of <br />Basalt, Colorado, who is a member of the Colorado River Water Conservation District <br />
