<br />. <br /> <br />. <br /> <br />RESOLUTION NO. 2003- 42 (REVISED*) <br /> <br />BOARD OF COUNTY COMMISSIONERS <br /> <br />OF THE <br /> <br />COUNTY OF SUMMlT <br /> <br />STATE OF COLORADO <br /> <br />A RESOLUTION ADOPTING POLICIES AND A PRICING STRUCTURE FOR <br />LEASING WATER RIGHTS TO QUALIFIED APPLICANTS UNDER SUMMIT <br />COUNTY'S PENDING APPLICATION FOR APPROVAL OF A WATER <br />AUGMENTATION PLAN. <br /> <br />WHEREAS, the Board of County Commissioners made application to the Division 5 <br />Water Court of the State of Colorado in June, 1995 for approval of its County-wide <br />Water Rights Plan for Augmentation (Case No. 95CWI22), hereinafter referred to as the <br />"Augmentation Plan". <br /> <br />. <br /> <br />WHEREAS, in addition to other uses, the County may provide replacement water under <br />lhe Augmentation Plan for existing or future wells that do not qualifY for well permits <br />which are exempt from administration under Section 37-92-602, c.R-S. , as a result of <br />current or proposed use of the well for an accessory dwelling unit, outside irrigation, <br />and/or watering of domestic livestock. <br /> <br />WHEREAS, the Board of County Commissioners desires to establish policies to govem <br />the leasing of augmented water rights under the Augmentation Plan to "Qualified <br />Applicants." <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF THE COUNTY OF SUMMIT, STATE OF COLORADO, <br />THAT THE FOLLOWING PROVISIONS AND THOSE CONTAINED IN THE <br />ATTACHED EXHIBIT A ARE HEREBY ADOPTED FOR THE LEASING OF <br />WATER RIGHTS BY SUMMIT COUNTY TO QUALIFIED APPLICANTS UNDER <br />ITS DECREED AUGMENTATION PLAN. Resolution 2003 - 42. <br /> <br />I. Applicants desiring to lease water under the Augmentation Plan from Summit <br />County shall document, according to established administrative procedures, that <br />they meet the following conditions and are therefore "Qualified Applicants." The <br />County may enter into a lease agreement with a Qualified Applicant ifall of the <br />following criteria are met: <br /> <br />. <br /> <br />A. Applicants own identified property in Summit County at a location where <br />leased water rights could be used to augment the well under the <br />Augmentation Plan and to meet the legal requirements to qualifY for a valid <br /> <br />J <br />
