I

I

MR. BAILEY:
MR. ROBERTS:

473

in advance. The program will have
the united support of both of those
groups."

At this point, Governor-elect Johnson arrived
at the meeting. Mr. Bailey introduced Governor-
elect Johnson to the Board.

Governor-elect Johnson said he was tremendously
interested in the water program of this State and
that he expected to be present at a lot of the
Board meetings.

"You might proceed, Mr. Roberts."

"Thank you, Mr. Chairman. I had spoken of the
fact ,.that we can assure agreement on the division
of any benefits that might be obtained. The
burden on the stream would only be 4,200 acre-
feet; They would be able to raise a fu}} hay
crop. Those are the objectives and possible
advantages of doing this. We believe, as
attorneys, .that. a real possibility for success
is present.

"The ability to determine what is consumptive
use has had great development since the Supreme
Court first had this matter. Justice Huahes
made the statement that this is an undet~rminable
matter. We. have reached the place whe're it is a
determinable matter. Improvement in methods of
evaluation since the old decree 1"as formulated
makes it possible to formulate a decree which
would be fairer. Another thing the Court would
listen to is that we can demonstrate now is
