3. Section 37-92-102(3), c.R.S. and ISF Rule 6 set fortb tbe standards for
evaluating acquisitions of water rights for ISF use,

The District has suggested that the CWCB add to Rule 6g the requirement that the
CWCB "make a determination that a loaned water right is necessary to preserve the
natural environment to a reasonable degree." Section 37-92-102(3) authorizes the
CWCB to acquire water rights "in such amount as the board determines is appropriate, , .
to preserve or improve the natural environment to a reasonable degree." ISF Rule 6e,
adopted by the CWCB in 2003, implements this statutory provision and guides the
CWCB on the evaluation ofthe appropriateness of an acquired water right. Therefore,
because the statute and ISF Rules already address what the CWCB must do in this
context; no additional language is needed.

In sum, Staff recommends that the CWCB adopt ISF Rules 6g and 6i as proposed
in the Notice of Rulemaking,

Respectfully submitted this 9th day of June 2004.

KEN SALAZAR
Attorney Ge ial
