Section 37-92-102(3), c.R.S. and ISF Rule 6 set fortb tbe standards for <br />evaluating acquisitions of water rights for ISF use, <br /> <br />The District has suggested that the CWCB add to Rule 6g the requirement that the <br />CWCB "make a determination that a loaned water right is necessary to preserve the <br />natural environment to a reasonable degree." Section 37-92-102(3) authorizes the <br />CWCB to acquire water rights "in such amount as the board determines is appropriate, , . <br />to preserve or improve the natural environment to a reasonable degree." ISF Rule 6e, <br />adopted by the CWCB in 2003, implements this statutory provision and guides the <br />CWCB on the evaluation ofthe appropriateness of an acquired water right.
