CO 80905-1743 <br />Phone: (719) 520-9288 <br />EMAIL: jwoldridge@waterlaw.tv <br /> <br />COMMENTS OF UPPER ARKANSAS WATER CONSERVANCY DISTRICT <br /> <br />The Upper Arkansas Water Conservancy District ("UAWCD"). by and through its <br />counsel, submits the following comments for consideration by the CWCB in the <br />rulemaking procedure to amend Rule 6g. of the Colorado Instream Flow and Natural <br />Lake Level Program: <br /> <br />1, UAWCD is a water conservancy district established pursuant to Water <br />Conservancy Act, CRS, 937-45-101, et seq. UAWCD owns. leases, or has the right to <br />use numerous water rights. conditional water rights, exchange rights, water rights <br />shares. and rights to water in the Arkansas River Basin, UAWCD operates North Fork <br />Reservoir. O'Haver Reservoir, Boss Lake. Cottonwood Lake Reservoir, and Rainbow <br />Lake, UAWCD operates decreed augmentation plans and a Rule 14 Plan for wells and <br />on-stream reservoirs in the Arkansas River Basin, <br /> <br />2, UAWCD is concerned that the procedures provided in C.R.S, 937-83-105 <br />(2) (2003) for evaluation of a loan of water for use as instream flows during an <br />emergency are not sufficient to effectively determine if injury will result to other water <br />rights, <br />3, Invariably, a loan of water for use for instream flows will involve a change <br /> <br />13972.63C j:IUAWCDICWCB comments <br />
