<br />6g, TemCJorarv Acquisitions, Pursuant to C.R.S. 837-83-105, the Board <br />hereby delegQtes authority to the CWCB Director to acquire water, water <br />rights, or interests in water for instream flow use for a period not to exceed <br />120 days in any basin or county in which the governor has declared a <br />drought emergency or in which any other emergency is declared, Further, <br />the Board hereby delegates to the CWCB Director the authority to take any <br />administrative action necessary to put the acquired water to /SF use. <br /> <br />(1) Staff shall employ the following procedures with respect to temporary <br />/SF acquisitions: <br />(a) Within seven days of receiving an offer for a temporary /SF right, <br />Staff shall compile and submit to the division engineer the <br />statement required by C.R,S. 9 37-83-105(2)(a)(/) and shall' assist <br />the party offering the temporary lSF in preparing and filing with <br />the division engineer the request for approval required by C.R.S. 9 <br />37-83-105(2)(b)(I). <br />(b) On the day the request for approval is filed with the division <br />engineer, Staff shall provide or cause to be provided written notice <br />of the request for approval by first class mail or electronic mail to <br />all persons on the substitute water supply plan notification list <br />established pursuant to C.R,S. 837-92-308(6) for the water division <br />in which the proposed loan is located, and Staff shall provide proof <br />of such notice to the division engineer. <br />(c) The Director need not decide whether to accept an offer for a <br />temporary /SF prior to submitting to the division engineer the <br />statement required by C.R.S. 837-83-105(2)(a)(/), However, prior <br />to the division engineer's decision on a request for approval, the <br />Director must either refuse or accept, on the condition of division <br />engineer approval, an offer for a temporary /SF right, <br /> <br />(2) The Director shall keep the Board reasonably apprised of activities <br />related to temporary lSF rights. <br />(a) Atthefirst regularly scheduled Board meeting after the Director <br />accepts an offer for a temporary lSF right, the Board shall vote <br />either to ratify or overturn the Director's decision, <br />(b) If the Direclor refuses an offer for a temporary lSF right that the <br />division engineer has approved, within ten days the Director must <br />provide public notice of and convene a meeting of the Board, in <br />person, by telephone or otherwise, At this meeting, the Director <br />shall explain the reasons for the refusal of the temporary lSF right, <br />and the Board shall vote either to ratifY or overturn the Director's <br />decision, <br /> <br />TU believes that these additions to the proposed rule will allow for efficient and <br />expeditious implementation of temporary ISF rights while allowing the CWCB and the State <br />Engineer's Office to review temporary ISF rights for conformity with the law. <br /> <br />2 <br />
