<br />supervision of the Board, and who shaH ha'Ve general supervision and control of
<br />all its activities, functions, and employees. '
<br />h. Diversion. Means removing water from its,natural course or location, or
<br />controlling water in its natural course or location, by means of a ditch, canal,
<br />flume, reservoir, bypass, pipeline, conduit, well, pump, or other structure or
<br />device; except that only a Local Governmental Entity may control water in its
<br />natural course or location for RlCDs. (37-92-103(7), C.R.S. (2001)).
<br />1. Findings of Fact and Recommendation. Means the written findings of the
<br />Board regarding the factors set out in sectiqn 37 -92-102( 6) and the RICD Rules
<br />and the written recommendation of the Board to the water court as to whether an
<br />application for a RICD should be granted, granted with conditions, or denied.
<br />j. Hearing Coordinator. Means the person appointed by the Director to be
<br />responsible for establishing the procedural rules, to the extent not otherwise set
<br />forth herein, which will govern the conduct of the public hearing(s) on a RlCD.
<br />k. Instream Flow (hereinafter referred to as 'IISF"). Means any water, water rights
<br />or interests in water appropriated or acquir~d by the Board, pursuant to section
<br />37-92-102(3), for preservation of the natur~1 environment to a reasonable degree.
<br />Pursuant to section 37-92-102(3), no other:person or entity may appropriate such
<br />rights, for any purpose whatsoever, in the State. (37-92-102(3), C.R.S. (2001)).
<br />1. Local Governmental Entity. Means an entity authorized to make appropriations
<br />for RlCD purposes and includes a county, municipality, city and county, water
<br />district, water and sanitation district, Water conservation district, or water
<br />conservancy district existing in the State of Colorado.
<br />m. Party. Means the Applicant for a RICD, any person that has filed a statement of
<br />opposition to a RlCD, or any person who J:\.as filed for party status pursuant to
<br />Rule 7 of the RICD Rules. '
<br />n. Person. Means an individual, a partnership, a corporation, a municipality, the
<br />state of Colorado, the United States, Or any other legal entity, public or private.
<br />(37-92-103(8), C.R.S. (2001)).
<br />o. Recreational In-Channel Diversion ("mCD"). Means the minimum stream
<br />flow as it is diverted, captured, controlled; and placed to Beneficial Use between
<br />specific points defined by physical control structures pursuant to a water court
<br />application filed by a Local Governmental Entity for a reasonable recreation
<br />experience in and on the water. (37-92-103(10.3), C.R.S. (2001)).
<br />p. Staff. Means the Director and other pers~nnel employed by the Board.

<br />5. Submissions Required from an Applic~nt. Within 30 days after filing an
<br />application for a RICD with any water court, an Applicant shall submit a copy of the
<br />application to the Board Office, pursuant to section 37-92-102(5), and shall also
<br />submit the following information: ,
<br />a. A description of RICD related structure~, including design plans for the physical
<br />control structures; :
<br />b. Maps showing land ownership, put-inltaRe-out areas, the ordinary high water line,
<br />and location of all physical control structures;
<br />c. Infonnation required by section 37-92-102(6)(b), including:
