In December 2005, the Town of Avon filed for a Recreational In-Channel Diversion ("RICD") water right
on the Eagle River as it flows through three structures located within the Town of Avon. The Application
is attached to the memo associated with Board Agenda Item No. 13.

The RICD statute provides that the Board may appear in water court to defend its findings with regard to
an RICD application. There a number of additional reasons why the Board may oppose the application,
and the Staff filed a statement of opposition in February.

Staff Recommendation
The Staff recommends that the Board ratify the Staffs statement of opposition for the Town of Avon
RICD case.
