<br />" <br /> <br />Agenda Item 21a(3) <br />Case No. 4-94CW237; San Juan Meadows Association, Inc. <br /> <br />e <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its March 13-14, 1995, <br />meeting. This is an application for a change of water rights on the Lake Fork of the <br />Gunnison River near the town of Lake City in Hinsdale County (see attached map). <br />Applicant seeks to change the point of diversion for the Seeley Ditch to a location <br />approximately 500 feet upstream of the present location. Applicant sites a change in the <br />course and depth of the Leak Fork Gunnison River as the reason for the new proposed <br />point of diversion. Applicant is also seeking to change the type of use of the Seeley <br />Ditch (4.0 cfs), the Seeley Ditch NO.3 (1.0 cfs), and the Seeley Pond NO.1 (2.3 AF) to <br />include uses as a supplemental supply or augmentation of wells in the San Juan Meadows <br />Subdivision. <br /> <br />The Board holds an instream flow decree for 45 cfs, summer, and 25 cfs, winter, on the <br />Lake Fork Gunnison River with an appropriation date of March 17, 1980. <br /> <br />Stipulation <br /> <br />The Applicant has agreed to the following terms and conditions which will provide full <br />protection of the Board's instrearn flow water rights on the Lake Fork Gunnison River. <br /> <br />e <br /> <br />. Applicant abandoned the proposal to move the ditch headgate 500 feet upstream. <br /> <br />. Applicant will curtail diversions for the Seeley Ditch water right for the new <br />additional uses at all times when the CWCB's Lake Fork of the Gunnision River <br />instream flow rights are not being satisfied immediately below Applicant's point of <br />diversion. <br /> <br />. Applicant shall install and maintain such measuring devices as are required by the <br />Division Engineer to administer the terms of its decree The Board, the State, and <br />Division Engineers shall have access to all measuring devices at reasonable times in <br />order to make readings therefrom. <br /> <br />.
