<br />'. <br /> <br />, <br /> <br />e <br /> <br />tit <br /> <br />tit <br /> <br />Agenda Item 21a(6) <br />Case No. 5-96CW286; Blue Valley Metropolitan District <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its July 21-22, 1997, <br />meeting. This is an application for augmentation and ground water rights on the Blue <br />River in Grand County near Kremmling (see attached map). Applicant seeks to augment <br />out-of-priority depletions from the Blue Valley Metropolitan District Pump and Pipeline <br />(a well/infiltration gallery) in order to supply water to up to 150 residences in the Blue <br />Valley Acres NO.2 Subdivision. The Applicant proposes to release augmentation water <br />from Green Mountain Reservoir in order to augment out-of-priority depletions associated <br />with this development. <br /> <br />The Board holds an instrearn flow decree on the Blue River for 60 cfs (Mayl - July 15) <br />and 85 cfs (July 16 - April 30) with an appropriation date of October 2, 1987. <br /> <br />Stipulation <br /> <br />The Applicant has agreed to the following terms and conditions which will provide full <br />protection of the Board's instrearn flow water right on the Blue River. <br /> <br />. At times when the Board's Blue River instrearn flow rights are not being satisfied <br />immediately below the Applicant's diversion structure, Applicant will either curtail <br />out-of-priority depletions or will replace out-of-priority depletions with a release of <br />augmentation water from Green Mountain Reservoir. <br /> <br />. Applicant shall install and maintain such measuring devices as are required by the <br />Division Engineer to administer the terms of its decree.
