<br />\~ <br /> <br />- 2- <br /> <br />not yet submitted formal written request to this effect, but the Staff believes that this request will be <br />made to allow the parties to actively pursue negotiations. The Staff recommends that the Board: <br /> <br />. <br /> <br />1. Confirm the Executive Director's appointment of Pat Kowaleski as the hearing <br />coordinator; and, <br /> <br />2. Instruct the Staff to continue to work with the Applicant and the affected water users <br />to develop a proposed decree that satisfies the requirements of Senate Bill 216 and the <br />CWCB rules; and, <br /> <br />3a. Instruct the hearing coordinator to establish the deadlines in a manner such that the <br />hearing can occur in conjunction with the Board's May Board meeting, or in the <br />alternative, <br /> <br />3b. Instruct the Staffto file a joint motion to delay the deadlines for filing the Board's <br />findings of fact and recommendations, and if the Water Court grants such a motion to <br />instruct the hearing coordinator to set a hearing schedule accordingly. <br /> <br />Town of Silverthorne <br />The City and County of Denver requested a hearing. The Applicant has requested, in writing, that <br />the Board file a joint motion with the Applicant requesting that the water court grant additional time <br />to the Board for making and reporting its Findings of Fact and recommendations, The Applicant . <br />cites, among other reasons, that the Board would have to have two hearings in May, the Applicant's <br />attorney has a trial already scheduled in late May, the Applicant has been having very fruitful <br />settlement discussions already, and additional time may allow these settlement discussions to come <br />to fruition. The Staff recommends that the Board: <br /> <br />1, Confirm the Executive Director's appointment of Pat Kowaleski as the hearing <br />coordinator; and, <br /> <br />2.
