The judge threw the case <br />out on the basis that the sanitarian or the <br />district engineer had not gone to the edge <br />of the cliff to see the sewage actually <br />entering the water.- Then he called every- <br />body into his chambers and said 'Well, now I <br />if they refile on the basis of inadequate ._ <br />treatment, I will have no recourse but to <br />fine you'. This was enough. They went ahead <br />and put in a small extended aeration plant <br />and since then he has actually written to us <br />thanking us because prior to that he had a <br />septic tank system. The problem was that on <br />a two-month period basis the septic tank would <br />be filled, the leaching field would be clogged <br />up and he would have to put in a new leach <br />well or leaching field. He found that he was <br />getting along cheaper now with the aeration <br />plant than he did before with the septic tank. <br /> <br />The CF&I, going back as far as 1960, <br />approached us and this was long before we had <br />any jurisdiction over industrial wastes, and <br />said 'This plant has been in since IBBO, we <br />don't know where all the lines are, we are <br />going to have to trace them out and we'd like <br />a six-year program to clean up our wastes'. <br />This was granted by the Board of Health who <br />had jurisdiction at that time. In '66 they <br />came in and said 'We guessed wrong. We are <br />going to need a little more time', which was <br />granted by the commission. In '6B they did <br />put in their domestic waste treatment facility. <br />Last Friday they dedicated an industrial waste <br />facility which includes both a treatment and <br />recycling facility. Myself, Mr. Ten Eyck and <br />others of the commission executive committee <br />were invited to attend but fortunately we <br />chose not to go. I think it was a good thing <br />in view of the snowst.orm that we had. The I <br />representative on the commission from Pueblo <br />did attend. <br /> <br />Great Western Sugar assures us that by <br />the end of this year they will have treatment <br />
