I talked to Kemmerer several <br />years ago. Kemmerer did not come into Montrose because of the Dallas <br />Creek Project. <br /> <br />Mr. Brooks: That is right. <br /> <br />Mr. Stapleton: Are there any further questions of Mr. Brooks on the <br />Dallas Creek Project? <br /> <br />Mr. Ford: I think rather than to take one project we are going to have <br />to work out many other problems if we are going to solve the energy <br />problem. The oil shale and development of the other areas are just as <br />apt to create pollution as the Dallas Creek Project. <br /> <br />Mr. Stapleton: This one was brought to our attention by the Governor <br />in his letter. I am not going to spread it further than that at this <br />time. The first <br />question I would like to ask is whether or not Kemmerer Coal has actually <br />made a firm commitment to purchase water from the project. <br /> <br />Mr. Brooks: Approximately three years ago Kemmerer Coal Company entered <br />into a contract with the Tri-County Conservancy District. It is an <br />option to purchase the water. <br /> <br />Mr. Weaver: This is not a firm contract. <br /> <br />Mr. Brooks: There is a question, the wor'iing of the contract is some- <br />what vague. Prior to the approval of the repayment contract it would <br />have to be determined if this is merely an option, or a binding con- <br />tract. There is a legal problem involved. <br /> <br />Mr. Weaver: It is also my understanding that the coal deposits in <br />question here are rather low BTU deposits; and the Kemmel."er Company.,has <br />trouble finding a power company that will buy this coal and build' <br />actually a power plant to use it.
