Davenport <br /> <br />2 <br /> <br />In the event that the QSA is not execu-ted by December 3 I, 2002, the approved diversion for <br />Nevada for CY 2003 is 454,520 af, which is equivalent to a consumptive use onoo,ooo af.l <br />Accordingly, CRC is requested to submit a revised monthly schedule for CY 2003 by January 3 I, <br />2003. CRC's revised schedule should reflect the Department's 2003 consumptive use limitation <br />onoo,ooo af. <br /> <br />43 C.F.R. Part 417, which provides for a thirty day notice period prior to the reduction ofa <br />requested water order, applies to supplies legally available to the State of Nevada. In the event <br />that the Quantification Settlement Agreement is not executed by December 3 1, 2002, surplus <br />water is not legally available under the 2003 AOP adopted December 16, 2002. Accordingly, <br />Nevada's approved water order does not include surplus and therefore is effective immediately. <br />This determination is not subject to appeal within the Department of the Interior. <br /> <br />We will be monitoring and projecting consumptive use of Colorado River water during CY 2003 <br />in an effort to ensure that the annual entitlement quantity of each authorized user is not exceeded. <br />These projections will be made available to water users on a monthly basis during CY 2003. Such circumstances include, but are not limited to modification of the 2003 AOP, <br />reinstatement of surplus detenninations based on the applicable provisions of the Interim Surplus Guidelines, <br />availability of unused apportiomnent, and changes in the beneficial use requirements of water users in the Lower <br />Basin States of Arizona, California and Nevada. <br />
