<br />Mr. Ronald R. Gastelum <br /> <br />3 <br /> <br />the approved water orders of senior right holders, not to exceed the 4.4 maflimitation for the <br />State's consumptive use. The Department is therefore approving a water order for MWD in 2003 <br />of713,500 acre feet (af) of consumptive use, the maximum amount of water which, subject to the <br />approved water orders of senior right holders, might be put to use by MWD in a year in which the <br />State of California is limited by the Decree and by State:statute to 4.4 maf, with surplus water not <br />available. <br /> <br />MWD is requested to submit a revised monthly schedule for CY 2003 by January 31,2003. <br />MWD's revised schedule should reflect the Department's 2003 consumptive use limitation of <br />713,500 af. <br /> <br />43 C.F.R. Part 417, which provides for a thirty daynotjce period prior to the reduction ofa <br />requested water order, applies to supplies legally available to the State ofCalifomia. In the event <br />that the Quantification Settlement Agreement is not executed by Decerriber 31, 2002, surplus <br />water is not legally available under the 2003 AOP adop~ed December 16, 2002. MWD's <br />approved water order does not include surplus water and is therefore effective immediately and is <br />not subject to appeal within the Department of the Interior.' <br /> <br />Reclamation will be monitoring and projecting consumptive use of Co 10rado River water during <br />CY 2003 to ensure that the annual entitlement of each water service contractor is not exceeded. <br />These projections will be made available to MWD on a monthly basis. It is expected that MWD <br />will use this information to adjust diversions to remain within approved annual quantities. <br /> <br />Sincerely, <br /> <br />Bennett W. Such circumstances include, but are not limited to modification of the 2003 AOP, <br />reinstatement of surplus determinations based on the applicable provisions of the Interim Surplus Guidelines, <br />repayment for overuse pursuant to the 2002 AOP SuppIement"and changes in the beneficial use requirements of <br />water users in the Lower Basin States of Arizona, California aild Nevada. <br /> <br />. <br /> <br /> <br />. <br /> <br />. <br />
