Gastelum <br />General Manager <br />The Metropolitan Water District <br />of Southern California <br />700 North Alameda Street <br />Los Angeles, California 90012 <br /> <br />Dear Mr. Gastelum: <br /> <br />By letter dated August 27,2002, and pursuant to Part 417 of Title 43, Code of Federal <br />Regulations (C.F.R.), The Metropolitan Water District of Southern California (MWD) requested <br />a net diversion of 1.25 million acre feet (mat) at Lake Havasu, the maximum quantity to which <br />MWD would be entitled under a Full Domestic Surplus determination in accordance with the <br />Interim Surplus Guidelines. The Bureau of Reclamation (Reclamation) consulted with MWD <br />with respect to its water order on November 18, 2002. <br /> <br />Acting on behalf of the Secretary ofInterior (Secretary) and pursuant to a specific Delegation of <br />Authority from the Secretary, this is the final 43 C.F.R, Part 417 determination of an approved <br />Colorado River Water order for MWD for CY 2003. . <br /> <br />Apl?roved Water Order ifOuantification Settleplent Agreement is Executed <br />bv December 31. 2002 <br /> <br />The availability of Colorado River water supplies within the Lower Basin is determined each year <br />by the Secretary of the Interior in the Annual Operating Plan for Colorado River System <br />Reservoirs (AOP). The Secretary's determinations in the AOP implement her role as water <br />master for the lower Colorado River pursuant to applicable federal law , as confirmed by the U.S. <br />Supreme Court in Arizona v. California, 373 U.S. 546 (1963). The Secretary adopted the 2003 <br />AOP on December 16, 2002. <br /> <br />The 2003 AOP specifically provides that in the event that the Quantification Settlement <br />Agreement and its related documents are executed by December 31, 2002, consistent with the <br /> <br />. <br /> <br /> <br />. <br /> <br />. <br />
