<br />. <br /> <br />MEMORANDUM <br /> <br />TO: Colorado Water Conservation Board Members <br /> <br />FROM: Dan Merriman <br />Mark Uppendahl <br /> <br />DATE: September 21-22,1998 <br /> <br />SUBJECT: Agenda Item 9a, September 21-22, 1998, Board Meeting-- <br />Instreani Flow Program - New Appropriations <br />Notice to Appropriate Instream Flow Water Rights in Water Division 1 <br /> <br />. GENERAL BACKGROUND <br /> <br />A Final Notice regarding the Board's Intent to Appropriate Instream Flow Water Rights was <br />distributed to the public on July 28, 1998. CWCB staff met with Dick Stencil of the Division 1 <br />Engineer's Office on August 23, 1996, to discuss any water availability problems regarding the <br />proposed instream flow segments. As per the Procedures for New Instream Flow Appropriations <br />(Procedures), adopted by the Board in May of 1997, the attached Phase III streams are being <br />proposed for Board appropriation. The Board at its January 1998, meeting, formed its intent to <br />appropriate the two stream segments in Gilpin and Jefferson Counties (see attached map). At this <br />meeting the segments were advanced to the Public Review and Comment and Board Action Phase, <br />or Phase III. The public has had at least 120 days to provide written or verbal comments to the <br />Board and staff. As of the date of this memorandum the Board's staff has not received any written <br />comments. Both proposed instream flow reaches are located within Golden Gate State Park and <br />were identified by the Colorado Division of Parks and Outdoor Recreation (CDPOR) for inclusion <br />into the instream flow program. <br /> <br />TECHNICAL INVESTIGATIONS <br /> <br />The enclosed packet of technical data forms the basis for the staff's recommendations and reflects <br />any changes to the instream flow recommendations as a result of the 120 day Public Review and <br />Comment Period. <br /> <br />. <br /> <br />Page I of3 <br />
