I

I

area. That battle is over. There is no possibility that we know of
for constructing any type of dam or structure within the boundaries of
the Dinosaur National Monument.

Mr. Moses: Mr. Chairman. I might add that if we could get the Lower
Yampa constructed, it is conceivable that we would be in a much better
position to agree to a minimum stream flow down below with storage
immediately above the Monument than we could without storage on the
river. That is one of the positives. We have no control over the flow
of the river below Maybell. If we had the Lower Yampa project or some
part of the Juniper or some substantial storage on the Yampa below
Craig, then conceivably we will be in a position to maintain a minimum
stream flow where nature refused to provide it. I think we have a
joint interest in that kind of a problem.

~tr. Reid: I believe the study the Bureau of sport Fisheries and Wild-
life is undertaking on the minimum requirements for the endangered
species will also be a factor there. The turbidity temperature of the
water as well as the flow are all factors in their survival.

~. Burr: i1r. Chairman.

~tr. Stapleton: ~tr. Burr.

Mr. Burr: May I ask if there is any privately owned water within that
wilderness area?

~. Reid: There is none that I know of. Do you know of any privately
owned water?

Mr. Kuiper, Mr. Chairman, I believe Wes Signs, as division engineer,
might be able to answer that question.

Mr. Siqns: Yes, there is a water right in the area.

Mr. Reid: Within the proposed wilderness area?

Mr. Burr: He will then be restricted with the wilderness area?

i1r. Jones: No, the private land is excluded.

ptr. Burr, You stated that there
it through the regular channels.
is added in there?

would be land added on without taking
Would that be some of the land that

-l3-
