<br />. <br /> <br />cSd?O~J7/ <br /> <br />. <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT is made and entered into this day of <br />, 1991 by and between the STATE OF COLORADO, acting <br />by and through the Colorado Water Conservation Board, <br />Depart~ent ~f Natural Resources (the "Board"), and the CITY OF <br />LAKEWOOD, a municipal corporation organized under the laws of <br />the State of Colorado ("Lakewood"). <br /> <br />. <br /> <br />RECITALS <br />A. Bear Creek Dam, also known as Mt. Carbon Dam, is <br />located in the City of Lakewood, Jefferson county, Colorado. <br />It was authorized by the U. S. Congress under the 1968 Flood <br />control Act (P.L. 90-483) and, pursuant thereto, is operated <br />by the united States Army Corps of Engineers (the "Corps") for <br />flood control and recreational purposes. Lakewood manages the <br />park surrounding the dam, known as Bear Creek Lake Park, for <br />recreational purposes under an agreement and long-term lease <br />from the Corps dated August 16, 1982 and August 17, 1982, <br />respectively. <br /> <br />B. Lakewood plans the construction of a public golf <br />course within Bear Creek Lake Park, known as the Fox Hollow at <br />Lakewood Golf Course.
