.

~
.

.

.

.

Agenda Item 12
May 28, 1991

this pOlicy, the donated right will not need to
exercise a call except during those rare occasion
when Aspinall operations are not adequate to
maintain 300 CFS.

4) By limiting the donated rights ability to call for
300 CFS to those times when storage in Blue Mesa is
above certain specified targets but only 200 CFS
when storage contents are below those targets we
can realistically simulate Reclamation's policy
while limiting the impacts of changing the donated
right to in stream flow to approximately 11,761 AF
annually. Given the subordination of the Aspinall
unit water rights to 60,000 AF of future upstream
in-basin depletions, any impact will not be felt
until after that 60,000 AF is fully utilized.
currently only about 1900 AF of the subordination
is being utilized.

Recommendations

The draft report has not yet been circulated for public review
and comment. Furthermore, all the appendices have not been
finalized. However, the findings of the report clearly suggest
that it is appropriate to proceed with a preliminary notice for
public consideration along with the draft report.

Therefore, staff recommends that the Board (1) authorize the
staff to release a preliminary notice seeking a 300 CFS instream
flow on the Gunnison below the Gunnison Tunnel with the donated
water right providing that instream flow; and (2) authorize the
staff to circulate the draft report for review and comment.

DRS/gl
Attachments

TNCAG591

3
