<br />. <br /> <br />. <br /> <br />. <br /> <br />Agenda Item 4h <br />Case No. 3-94CW039; USA <br /> <br />ADJllication Summary <br /> <br />This is an application for a surface water right on East Middle Creek near Saguache in Saguache <br />County (see attached map). Applicant is requesting 3.5 cfs from October through March and <br />1.0 cfs from April through September for instream flow purposes. The Board does not hold an <br />instream flow right on East Middle Creek at this time. <br /> <br />Potential for Iniury <br /> <br />Applicant is claiming instream flow uses for fisheries, aesthetics, outdoor recreation, range <br />management, timber, watershed protection, and wildlife purposes. Because the applicant has not <br />diverted or otherwise captured and controlled the waters, and since the Board is the only entity <br />authorized to appropriate instream flow water rights, the staff has filed a statement of opposition <br />in this case. <br /> <br />Other Obiectors <br /> <br />Other objectors include the Rio Grande Water Users Association, Rio Grande WCD and the <br />Colorado Environmental Coalition. <br /> <br />File = C:\wp51\board.mem\sop\394CW039.SOP <br />
