<br />. <br /> <br />e <br /> <br />. <br /> <br />e <br /> <br />Agenda Item 4b <br />Case No. 1-94CW277; Gilpin County <br /> <br />Application Summary <br /> <br />This is an application for conditional water rights, a change of water rights, and approval of a <br />plan for augmentation including exchanges on Ralston Creek near Black Hawk in Gilpin and <br />Jefferson Counties (see attached map). Applicant's conditional water rights include the diversion <br />of ground water tributary to North Clear Creek and Ralston Creek and diversion of surface water <br />for storage at the Sea of Storms Reservoir Enlargement on Ralston Creek. Applicant is also <br />proposing to change its prorata share of Tucker Lake from irrigation to municipal uses and store <br />these shares in the Sea of Storms Reservoir. In addition, applicant is seeking adjudication of a <br />conditional right of exchange for 1 cfs between Farmers' Highline Canal where it crosses Ralston <br />Creek and Sea of Storms Reservoir. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow decree for of 0.5 cfs on Ralston Creek with an appropriation <br />date of September 5, 1986, which could be injured by this application. <br /> <br />Potential for Iniury <br /> <br />Applicant's change of use and change in point of diversion of its senior irrigation water rights <br />may deplete the Board's instream flow right on Ralston Creek. <br /> <br />Other Objectors <br /> <br />There are no other objectors in this case.
