Applicants are seeking absolute and
conditional water rights for recreational uses, development of a fishery, and fish habitat along
a 2.5 mile segment of the South Platte River stretching from a point approximately 0.5 miles
north of C-470 to a point approximately 1 mile south of Main Street in Littleton. Applicants
identify a number of existing and proposed structures within this segment of the river that will
be relied on to accomplish the proposed uses. The existing structures include 7 boulder clusters,
4 deflectors, and 9 boat chutes. The proposed structures include 1 additional boat chute and 1
boulder cluster. Applicants claim 30 cfs, winter, and 70 cfs, summer for the boulder clusters
and deflectors. Applicants are claiming 100 cfs for the operation of the boat chutes.

CWCB Appropriations

The Board does not hold an instream flow right on this segment of the South Platte River.

Potential for Iniurv

Applicants' request for absolute and conditional water rights for instream uses may conflict with
the provisions of Section 37-92-102 (3), c.R.S. (1990). Said Section provides: "... no other
person or entity [other than the Board] shall be granted a decree adjudicating a right to water or
interests in water for instream flows in a stream channel between specific points, ..., for any
purpose whatsoever. "

Other Objectors

There are no other objectors in this case.
