Provided, <br />however, the operation of Ruedi Reservoir to meet these storage amounts and limiting the <br />maximum release pursuant to this MOA shall not be precedent nor bind Reclamation to this <br />operation ofRuedi Reservoir beyond the scope and term of this MOA. <br /> <br />8, ENVIRONMENTAL COMPLIANCE <br /> <br />The Environmental Compliance for performance under this MOA is pursuant to EIS-88-1 0, <br /> <br /> <br />FSES-89-19, and Categorical Exclusion Checklist No. BCAO- 01-34. <br /> <br />9. ENFORCEMENT <br /> <br />a. The Board will take such action under state law, including requesting administration by the <br />State Engineer's Office and initiating water court proceedings, as may be necessary to obtain <br />delivery of the water from the outlet works of the dam from which the water is released to the <br />beginning of the IS-mile reach and to protect the release from diversion by third parties within <br />the IS-mile reach, subject to such transit losses as may be imposed by the State Engineer or the <br />Division Engineer for Water Division 5. Reclamation will cooperate with the Board to protect <br />the water released from the outlet works of the dam from which the water is being released <br />through, and to the downstream terminus of, the IS-mile reach. <br /> <br />b. The terms and conditions of this MOA shall be enforceable by any party to this agreement in <br />a court of competent jurisdiction; Provided, however, that before commencing an action for <br />enforcement of this contract, the party alleging violation shall notify the other parties in writing <br />of the alleged violation, and the parties shall make a good faith effort to resolve their differences <br />through informal discussions. <br /> <br />11 <br /> <br />I' <br />
