TERMS OF TillS AGREEMENT <br /> <br />This MOA becomes effective on the date first written above and shall remain in effect through <br />December 31, 2001; Provided that the furnishing of water herein is temporary. It is a delivery of <br />water for the term of this agreement and shall not be considered as binding Reclamation to <br />furnish or the Board to lease water beyond the term of this agreement or in any future year. <br /> <br />3. DELIVERY OF WATER <br /> <br />a. The Project shall be operated in accordance with the Operating Principles for the Fryingpan- <br />Arkansas Project as set forth in House Document No. 130, 87th Congress, 1 st Session. <br /> <br />b. Reclamation hereby leases to the Service, and the Service hereby subleases to the Board, <br />10,825 acre-feet of water from the regulatory capacity of Ruedi Reservoir, as defined in <br />Article I.e. hereof, subject to the terms and conditions of this MOA. Water shall be released <br />from Ruedi Reservoir for use by the Service and the Board in and through the 15-Mile Reach as <br /> <br />described in Article 6.a. herein. <br /> <br />c. Reclamation shall deliver the water under this MOA to the Fryingpan River from the outlet <br />works of Ruedi Reservoir. All delivery of water will be limited by the capacity of the outlet <br /> <br />works. <br /> <br />d. All water releases will be measured at the outlet works by the Contracting Officer with <br /> <br /> <br />equipment furnished, operated, and maintained by Reclamation. The Service through the <br /> <br /> <br />Recovery Program shall install, operate, maintain, and replace any waterflow measuring and <br /> <br /> <br />recording devices necessary to accept delivery and protect the water in the 15-Mile Reach. <br /> <br />7 <br />
