<br />Colorado Water Conservation Board Easement Fee Structure <br /> <br />Note: The Colorado Water Conservation Board approved this fee structure at its March 13, 1996 meeting. <br /> <br />Procedure for the Computation of Easement Fees: <br /> <br />Method I - Market Value Method <br /> <br />This method shall consider the market value of the subject site. It will require an appraisal or <br />market survey to detennine the fair market value of the property subject to the easement, based <br />on comparable land values in the area at the time of negotiations. Applicants for easements must <br />provide such appraisals/surveys to the CWCB, at their:expense, to establish the fair market value <br />of the subject property. <br /> <br />The easement value is computed as follows: : <br /> <br />Step 1- Detennine the market value of the property in square feet or acres. <br />Step 2 - Detennine size (area) ofimpayted CWCB property. <br />Step 3 - Select an easement class factot from the Land Use Compensation <br />Schedule (attached as a part of Exhibit )3*) which considers the development <br />potential of the site. <br /> <br />Value Formula <br /> <br />Value = (Market value rate/area) X (area in sq. ft. or acres) X (easement class factor). <br /> <br />Value = Dollar value is for a lump sum payment at beginning of easement tenn. The easement is <br />renewable in (25) years and the consideration for renewal will be the computed amount adjusted <br />for inflation. . <br /> <br />Method II - Drainal!e Value Method <br /> <br />This method shall use an annually established standaril rate that will be applied equally to all <br />applications regardless of the particular location ofth~ easement. This method applies only to <br />easements where a floodwater discharge is passing o~er or through an existing or newly <br />constructed project feature or facility (weir, culvert o~ pipe, inlet box, spillway or other structutal-- " <br />design feature). No charge will be assessed for the p~ssage of floodwaters over natural <br />conveyance paths or man-made earthen channels. <br /> <br />The easement value is computed as followsi <br /> <br />Step 1 - Use the Urban Drainage & Flood Control District easement fee rate, <br />which is $1.00 sq. ft.. <br /> <br />\ <br /> <br /> <br />e <br /> <br />e <br /> <br />.e <br />
