storage space of 20,600 acre-feet can be made available pending the outcome of the EIS report and related
studies. Several draft chapters of the EIS have been released to the participating entities (namely the 16
water users and the CWCB) for review and comment. .

Cherry Creek Probable Maximum Flood (PMF) Study: On February I, 2006 CWCB staff met with
various members of the Corps of Engineers team that has been assembled to participate with activities
related to the PMF study. The Corps of Engineers Study Manager, Mr. John Palensky. chaired the
meeting and provided an overview of the process along with projected key milestones of the study. This
meeting was considered to be an internal kick-off to re-initiate studies based on direction received from
Colorado Congressional delegates Tom Tancredo and Joel Hefley who approved the Corps to move
forward with the Cherry Creek PMF Study. The Corps will work closely with the Cherry Creek Advisory
Committee and the CWCB during this important next phase of the work. This PMF study will be
completed by Omaha Corps professional staff. The Corps and the CWCB are developing a work plan and
meeting schedule for the next year or two, and will jointly host a public meeting with the affected
communities (Aurora, Greenwood Village, Denver, Douglas County, and Arapahoe County) along with
various technical experts. The ultimate goal in this process is to complete the PMF study and then
develop dam safety improvement recommendations at Cherry Creek Reservoir that are acceptable to
local, state. and federal interests.

Platte River Recovery: The Federal government is expected to issue a Final Environmental Impact
Statement ("FEIS"), and Biologic Opinion ("BO") prior to the Board meeting. A detailed description of
the history and makeup of the proposed Program is on the CWCB's agenda.

South Platte River Easements Update: In November 2005 CWCB Members approved two easements
for the expansion of the Columbine Valley Country Club golf course and a stormwater pipeline
realignment for Roxborough Park Metropolitan District (RPMD). RPMD's stormwater pipeline easement
was made in conjunction with the wastewater pipeline previously approve by the CWCB Members in .
2005. Easement agreements for the RPMD 5 mile wastewater pipeline and the stormwater pipeline
realignment have been executed. In addition, the Columbine Valley Country Club easement agreement is
in the signatufe process and should be executed in the very near future. The $125,000 total easement
fees generated from these agreement agreements will serve a very useful purpose and will allow Staff to
cost share with the Urban Drainage and Flood Control District for maintenance activities along the
Chatfield Downstream Channel Improvement Project reach (also known as the CWCB floodplain right-
of-way).

Denver Water Board Adopts 2006 Summer Water Use Program: On April 23, the Denver Water
Board adopted the 2006 Summer Water Use Program. Even though Denver Water's customers reduced
water usage by nearly 20% over the last few years, the Board stated their desire to reinforce these good
habits and also to continue to encourage responsible stewardship of water in this semi-arid region. To
help customers continue their wise water use habits and avoid wasting a valuable resource, it is
recommended the 2006 Summer Water Use Program, effective from May I to September 30, 2006,
include the following elements:

. Customers are directed to water lawns no more than three days per week, selected at their
discretion, and only as much as the landscape needs.
. Each customer is to receive a document by direct mail that provides instructions for the 2006
Summer Water Use Program and gives helpful information for determining the correct amount of
water (in inches and minutes) that should be applied to the landscape.
. A reminder of Chapter 12 of the Board's Operating Rules which contains definitions of water
waste

.

20
