Beginning with each year's April 1 forecast from the Colorado River-River <br />Forecast Center, if Blue Mesa is projected to fill and spill by July 31 st, water <br />beyond that which satisfies present and future obligations of the authorized <br />purposes of the Aspinall Unit, as specified in the Colorado River Storage Act, 43 <br />U,S,C, Section 620 et seq" as amended through April 2, 2003 (see Agreement _ <br />Black Canyon of the Gunnison National Park, Paragraph (I )(b,), and <br />2, Further, the amount of water for rSF purposes shall be limited to a maximwn of <br />10,000 c,f,s" or such lesser amount, that when combined with tributary inflow <br />occurring upstream of the Gunnison River gage located near Delta, CO does not <br />exceed 10,000 c,f.s, (to ensure that the rSF water right does not contribute to <br />flooding in the Delta area); and <br />3, This instream flow water right shall not be exercised in a mauner that interferes <br />with Aspinall Unit operations, <br /> <br />- 5 - <br />
