Under the 1986 MOA, the District and the DOW are each responsible for stocking 2,500 pounds <br />of catchable rainbow trout in Black Lake No, 1 aunually, Upon completion of the proposed <br />reservoir enlargement, the District will assume responsibility for stocking all 5,000 pounds of <br />catchable rainbow trout aunually, <br /> <br />. Under the 1986 MOA, the District and the DOW share responsibility for structural integrity, <br />maintenance and operations of Black Lakes Nos, 1 and 2, Upon completion of the proposed <br />reservoir enlargement, the District will assume responsibility for all of the structural integrity, <br />maintenance and operations costs for Black Lakes, <br /> <br />Recommendation <br /> <br />Staffs at the CWCB, DOW, AGO and DNR have been involved in negotiations with the District's <br />staff, consultants, and attorney during the past few months to draft the new MOA. The Colorado <br />Wildlife Commission approved the Black Lake Enlargement on May 5, 2005 (attached). Staff <br />requests that the Board recommend that the Department of Natural Resources enter into the proposed <br />MOA with the Eagle River Water and Sanitation District. In so recommending, the Board will concur <br />with the Colorado Wildlife Commission's action on the Black Lake Enlargement MOA and reserve <br />the Board's right to file statements of opposition in any water court application filed by the District in <br />connection with the MOA to support the implementation of the MOA and to ensure protection of the <br />Board's instream flow water rights on Black Gore Creek and Gore Creek. <br /> <br />Attachments <br /> <br />Flood Protection.
